Football’s never ending dilemma’s syndrome scripted by the governing bodies FIFA and UEFA sisters in fraud, the Manero has long advocated challenging the governing bodies on their strangulation regulations laid down and the never ending birthing of tournaments in their quest to fill their bank vaults. The former French International Lassana Diarra took the baton up a decade ago with the player laying claim to FIFA restricting him under the umbrella freedom of movement between clubs on players transfers has opened the ten year rotten can of worms to be stagnating in the system till now with the European Court of Justice serving FIFA’s rules as illegal to be in breach of European Union law.
Time to date back to the year 2013 when Diarra signed a four year contract with Lokomotiv Moscow, the contract was terminated a year later with Diarra unhappy with a reduction of salary due to the player’s poor performances club cited, on the Manero watchdog if not entered into the players contract then Lokomotiv had not grounds of any legal standing without inserted clauses. The FIFA rule book to adjudicate came into play to err on the side of Lokomotiv, who were seeking compensation in FIFA’s resolution chamber after learning of the player seeking compensation, Diarra challenged the FIFA rule book. Diarra appealed to the CAS (Court of Arbitration for Sport), who determined that Lokomotiv were withing their pitch to terminate the player’s contract and was slapped with a 8.8 million pound bill to footnote Lokomotiv’s way. It has to be said that CAS are a fleet footed organisation who can run rogue with their rulings.
FIFA then proceeded to methodically break the player’s career to block Diarra’s path to finding another club and imposed on any club to sign Diarra would mean that the club would be liable to pay the 8.8 million pound fee imposed on Diarra, this is to restrict the players freedom of moment, to become a servant to FIFA. The Belgian Club, Royal Charleroi SC wanted to free Diarra from the FIFA shackles and register the player with the club, the move broke down and Diarra sued FIFA and the Belgian Federation at a Belgian court for damages and loss of earnings marked down at 5 million pounds, the lawsuit is still ongoing compounded with the Belgian court not acting efficiently and has been connected to the European Court of Justice. The Diarra case is supported by the global players union the FIFPRO. On the 5th October the European Union (CIEU) findings were that FIFA’s laws on transfers is illegal contrary to EU law, which will change the footballing landscape if continued in the same vein to kick in within next two years to fester within the game.
Football’s nuked smoking tinder box will offer the agents more freedom of movement to invoke their dirty play book to fill their bank vaults, shorter player contracts could become the norm and to break the player’s contracts on the get go. So will the contracts have any credibility? Does not seem to be the case, to be a disaster zone for English football the bargaining power will shift to the layers to add to their kilt, it could be feasible that clubs cannot command transfer fees, stability will have to be set in play to allow clubs to stabilize to such an impactful switch.
In February 2016, FIFA president Gianni Infantino stated that to modernise the transfer market rules would be the priority, all hot air never materialised, Infantino has now been caught with his pants down, caught short, a sight not to behold, squelch! The smoking tinder box on the termed freedom of movement, players contracts and agents roaming rogue free according to FIFA does not have far reaching implications with the ruling intervening two paragraphs to the FIFA status and transfer of players, Infantino to moonshine on that statement, poppycock.
There are similarities to the Belgian midfielder John Marc Bosman landmark ruling in 1995, when Bosman challenged the FIFA system on the expiry of players contracts with players movements. The shackles at the time were to restrain a player from moving to another club at end of contract if the player’s club so wished, a Bosman transfer to another club was blocked, the termed restraint of trade, Bosman won the case v FIFA to the themed players expiry of contract to allow players to transfer. The Diarra case is still ongoing. To trace back to Diarra’s discrepancies with Lokomotiv Moscow, FIFA banned Diarra for one season, 2013-2014 and returned to football with Olympic Marseille pending the court judgements and ten years as we stand point today my lord, other clubs to become on the Diarra CV were Al Jazira and Paris Saint-Germain, Diarra retired in 2019. Football’s smoking tinder box continues to smoulder.
